Am I allowed to send DMCA takedown notices even if I'm writing fanfic?

Fanfic authors own the original elements that they created (as distinct from what the underlying author created). This is from the Legal Chair of the OTW (parent organisation of AO3) Prof. Betsy Rosenblatt. Source

So yes, you are allowed to.

Why do you only identify Archive of Our Own (AO3) content?

Because we do not yet have the resources to also scan other websites. We would like to, but we can't at the moment.

Also, AO3 is the most stable out of all three major websites. It is the one most likely to still be around in 10 years time - fanfiction.net is under-maintained, and Wattpad is transitioning away to original fiction. This is a long-term project, so the choice of AO3 is a long-term consideration.

Terms of Service

We provide service to all fannish authors of transformative works, with the following exceptions:

You must not commercialise your fanworks. We take the view that if you commercialise your works, then you are solely responsible for safeguarding your works from copyright theft.

This refers to paywalling, accepting sponsorships, or publishing your works through a publisher. It does not include soliciting for donations or commissions.
This is not in any way related to the no-commercialisation rule set by AO3. If you publish on AO3, you should observe their terms of service as well as ours.
This rule exists because I cannot ask my volunteers to donate their time for free in order to aid the commercial interests of other individuals.

You must not behave in a way which would cause harm to other authors.
